TREATD TERMS AND POLICIES

Please read these Terms and Policies carefully before using our Website or our Apps and before booking any third party goods or services through our Website or our Apps. We recommend that you print a copy of these for future reference.

By using our Website or our Apps, you confirm that you accept these Terms and Policies and that you agree to comply with them regardless of whether you choose to register with us. If you do not agree to these Terms and Policies, you must not use our Website or our Apps in any way.

TREATD CONSUMER AND COMMUNITY MEMBER TERMS OF SERVICE

  1. Welcome to our website, www.treatd.co.uk (“Website”) and to the Treatd Customer mobile application. The Website and our Apps are provided by (t/a Treatd), a company registered in England under company number 12504905.
  2. The Website and our Apps have two main functions:
    1. aggregating of information and providing a centralised booking point for selected third party goods and services providers who wish to offer their goods and services for sale via our Website and our Apps (“Partners”); and
    2. provision of general information relating to beauty and wellbeing.
  3. We have set out the terms under which we are providing you with access to our Website and our Apps and any products or services we offer from our Website or our Apps. These include the terms and conditions that govern:
    1. your rights to use and link to our Website and our Apps (these “Website & App Terms of Use”);
    2. how we will use and protect information about you (our “Privacy & Cookies Policy”) and
    3. our booking terms and conditions in relation to the third party products or services we offer from the Website or our Customer mobile application (our “Booking Terms and Conditions”); and
    4. your obligations when uploading comments or other contributions and content to our Website or our Apps (our “User Generated Content Policy”),
    5. together or individually these may be referred to as our “Terms and Policies”.
  4. Please note that the Terms and Policies do not govern the relationship as between Treatd and our Partners. If you are an existing Partner, please check the Partner Terms of Business provided to you upon sign up. If you are not yet a Partner but would like to apply to Treatd to become one of our Partners, please see www.treatd.co.uk/listyourbusiness
  5. If you enter any prize competitions or other promotions on the Website or our Apps, separate terms and conditions may also apply in addition to our Terms and Policies. In the event of a conflict between any additional terms and conditions and our Terms and Policies, such additional terms shall prevail to the extent of the conflict.
  6. We may change our Terms and Policies from time to time, in which case up to date versions of such Terms and Policies will be available via the Website and our Apps. You should check these Terms and Policies regularly to ensure that you are happy with any changes. You will be deemed to have accepted any changes to the Terms and Policies after you have been notified of the changes on our Website or our Apps and/or if you continue to access or use the Website or our Apps, where the updated Terms and Policies will be available for you to view.
  7. You may use the Site only to post reviews (including photos and videos) based on your own personal experience, to communicate with other community members about questions on personal care, beauty, and wellness and to post questions on the Site. You may only use the Site for personal, non-commercial uses, bookings and purchase of products provided by Healthcare, Beauty or Wellness Providers, and you may not use the Site to advertise or promote a product, service, procedure, business, health care, beauty, wellness provider or another person.
  8. You may not use the Site:
    1. If you are under 18.
    2. In any way or for any purpose that is against any local, government or any other applicable laws.
    3. In any way or for any purpose that harms or endangers us or our affiliates, resellers, distributors, service providers and/or suppliers (collectively, the “Treatd Parties”), or any customer of a Treatd Party;
    4. To exploit, solicit or harm minors;
    5. To copy any Content from the Site, including, but not limited to, photographs, and post those photographs or other Content on another third-party website.
    6. To post or submit any Content that is racist, sexist, inflammatory, defamatory, hateful, harassing, threatening, abusive, profane, obscene, vulgar or sexually explicit, false, misleading, fraudulent, invasive of another’s privacy or publicity rights, infringing of another’s intellectual property rights, contains any trade secrets or other confidential information, or otherwise offensive or objectionable;
    7. To promote, encourage or glorify violence, self-harm, suicide, anorexia, bulimia, or any other practice that is unhealthy or harmful;
    8. To post your name, email address(es) or telephone number(s), URL(s) or any other confidential or personally identifiable information about you or any other person on the Site;
    9. To provide or purport to provide medical advice, prescription, diagnosis, or treatment recommendations;
    10. To register for multiple accounts or use the account of another person without their authorisation;
    11. To impersonate or pretend to be any person other than yourself, including to impersonate or pretend to be a health care or wellness provider;
    12. To attempt to solicit business or direct website visitors to a non-Treatd site for commercial purposes or spamming any Treatd health care and wellness providers, community members or other users;
    13. You agree not to use any data mining, robots, or similar data gathering and extraction methods in connection with the Site;
    14. To post links to sites or files that contain or are viruses, spyware, malware, or other harmful content;
    15. To attempt to interfere with or disrupt the Site or any person’s ability to use the Site;
    16. To create and upload reviews or comments in exchange for monetary compensation or other incentive; or
    17. For any purpose for which the Site is not intended.
  9. We may tell you about certain specific harmful or additional prohibited uses in our Community Guidelines or other notice available through the Site. We have, however, no duty to do so. You agree to abide by any Code of Conduct or other notices we provide, which may be changed from time to time. Without limiting the foregoing, you agree to abide by these Terms, the Code of Conduct and any other policies Treatd has in place. Any use of the Site other than as specifically authorised herein, without the prior written permission of Treatd, is strictly prohibited. In addition, Treatd is not obligated to enforce these Terms against another user, health care, beauty and wellness provider or other third-party on your behalf. If you believe another user, health care, beauty, wellness provider or other third-party has violated these Terms, then please contact Treatd by email: Hello@treatd.co.uk . Treatd reserves the right to investigate the matter and take whatever action Treatd deems appropriate in its sole discretion.
  10. By using the Site, you consent to receive emails from Treatd, which may include commercial emails provided such emails are in accordance with the preferences you select in the email and notifications page of the My Profile section of the Site. You may change such preferences by changing your account settings on the email and notifications page of the My Profile section of the Site or via the unsubscribe link in all commercial emails. Please note that as long as you maintain a Service Account, you may not “opt out” of receiving service or account-related emails from Treatd and all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
  11. You may be able to post or submit reviews, comments, questions, direct messages, photographs, videos (including videos created through a third-party tool) and other materials on or through the Site (collectively, “Submission” or “Submissions”). Your Submissions, (including to the extent applicable personally identifiable information), are made voluntarily and are subject to the Treatd Code of Conduct and the Treatd Privacy Policy. You understand Treatd is not required to treat any of your Submissions as confidential. In addition, you understand and agree that your Submissions (including your username associated with your Submissions) are not confidential and are publicly available for anyone to view on the Site.Treatd does not claim ownership of the Submission(s) you post or submit on the Site. With the exception of any information you directly submit through a health care & wellness provider’s profile or inquiry form, by posting or otherwise providing your Submission on the Site, you are hereby expressly granting Treatd a nonexclusive, irrevocable, worldwide, perpetual, royalty free license (including sublicense) to use, copy, distribute, publicly display, publicly perform, modify (including create derivative works) or transmit (including digital transmission of a sound recording) your Submission, in connection with the Site and the Treatd business, including without limitation promoting and redistributing part or all of the Site or the Treatd business, in any media formats and through any media channels now known or hereafter developed. You also grant Treatd permission to publish and use your name, likeness and voice in connection with your Submission. In addition, by uploading a Submission to the Site, you hereby waive any rights of privacy or publicity. You also grant Treatd the right to grant any of the above rights to other persons or entities, including for the purpose of promoting the Site or the Treatd business, without any compensation or obligation to you. You also grant Treatd the right and authority to send takedown notices (on your behalf) related to your Submission to any individual or entity under the Digital Millennium Copyright Act.Treatd will not pay you for your Submission. You also understand and agree that Treatd may, in its sole discretion, refuse, or remove part or all of your Submission from the Site at any time if Treatd considers the Submission to be illegal, offensive, harassing, infringing, inappropriate or otherwise violates these Terms or the Treatd Code of Conduct or other policies. For each Submission, you represent and warrant that you have all rights necessary for you to post or submit the Submission and to grant the licenses and permissions in this section and that you are solely responsible for the content of your Submission. Further, you represent and warrant that your Submission does not violate any law. Treatd reserves the right to review and monitor Submissions but is under no obligation to do so. In addition, Treatd is not responsible for screening, monitoring or editing Submissions. However, we may monitor your Submissions and may disclose information about you, including the contents of such Submission, if we deem it necessary to: (1) conform to legal requirements or respond to legal process; (2) ensure your compliance with these Terms or other Treatd guidelines or policies; or (3) protect the rights, property, or interests of Treatd, its employees, its users, or the public. You may also request information directly from a specific health care, beauty & wellness provider by submitting an inquiry through their profile or inquiry form. You understand these requests, including personally identifiable information, are made voluntarily and are subject to the Treatd Privacy Policy. There is no guarantee that a health care, beauty & wellness provider will respond to any request submitted through their profile or inquiry form. In addition, by submitting a request to a health care provider through the Site, you understand that Treatd may contact you by phone, email or text message about your request. All standard message and data charges will apply to any text messages.
  12. Treatd does not have any responsibility, including editorial control, of any content posted by other Treatd community members, health care, beauty & wellness providers or other third party content providers on the Site. The statements or content posted by Treatd community members, health care, beauty & wellness providers or other third party content providers on the Site are those of the community members, health care, beauty & wellness providers or other third party content providers and are not the opinion of Treatd. Treatd does not make any representations or warranties about the accuracy or reliability of the content, including the opinions, statements or information posted by the Treatd community members, health care & wellness providers or other third party content providers on the Site. The Treatd community members, health care, beauty & wellness providers and other third party content providers are solely responsible for the content posted by them respectively.Treatd does not endorse or recommend any specific content, procedures, products, opinions, health care, beauty & wellness providers or any other material or information available on the Site. In addition, the health care, beauty and wellness providers featured on the Site are not employees or independent contractors of Treatd and Treatd does not make any warranties about the qualifications of the health care, beauty & wellness providers or the costs of the procedures or products featured on the Site. Treatd only verifies and conducts background check on health care, beauty and wellness providers, but does not make any warranties. There may be medical related or health related materials posted by Treatd community members, health care, beauty & wellness providers or other third parties that contains nudity. If you find these materials to be offensive, then you may want to use the Site in such a way as to limit your viewing of this material.
  13. Copyright Policy:If you believe that your Submission or any other work has been used in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Treatd at hello@treatd.co.uk. Provide all of the following in writing: (1) identify the copyrighted work you claim has been infringed or if multiple copyrighted works, then a representative list of such works on the website; (2) identify the material on the website that you claim is infringing and with enough detail so that we may locate the material; (3) provide a statement that you have a good faith belief that the use of the material on the website is not authorised by the copyright owner, its agent, or the law; (4) provide a statement declaring that the notification is accurate, and, under penalty of perjury, that you are the owner of the copyright interest involved or that you are authorised to act on behalf of the exclusive owner; (5) provide information reasonably sufficient to permit Treatd to contact you, such as an address, telephone number, and email address; and (6) your physical or electronic signature.Upon receipt of notice as described above, Treatd will take whatever action, in its sole discretion, it deems appropriate, including removal of the alleged infringing material from the website.
  14. Photograph & video Policy: Health care, beauty & wellness providers must have consent from individuals and comply with all applicable laws (as well as the HCP Terms, Privacy Policy, Code of Conduct and the Health Care, beauty & Wellness Provider Photo & Video Guidelines) before uploading, submitting or posting any photographs or videos of individuals on the Site. If a health care, beauty & wellness provider or other third-party has submitted, uploaded or posted a photograph or video of you on the Site and you want that photograph or video removed from the Site, please contact Treatd hello@treatd.co.uk . Please provide the following information about the photograph or video in order for Treatd to be able to identify the photograph: (1) identify the photograph and provide Treatd with enough detail about the photograph so Treatd can locate it on the Site; (2) provide a statement that you have a good faith belief that the photograph is of you and was either not authorised to be uploaded, posted or submitted to Treatd or your health care & wellness provider had permission to upload, post or submit the photograph but you no longer want the photograph displayed on the Treatd Site; (3) provide a statement declaring that the notification is accurate, and, under penalty of perjury, that you are the person in the photograph or that you are authorised to act on behalf of the person in the photograph; (4) provide information reasonably sufficient to permit Treatd to contact you, such as an address, telephone number, and email address and (5) your physical or electronic signature.
  15. Links to other Websites; Third-Party Promotions: The Site may contain links to other websites maintained by third parties (“Third Party Website”) or you may be able to log into the Site through a Third Party Website. Third Party Websites are not under the control of Treatd and Treatd does not endorse or assume any responsibility for the content, information or functionality of any Third Party Website. As a result, your access or use of any Third Party Website is at your own risk and these Terms, Privacy Policy, Code of Conduct and any other policies do not apply or govern any Third Party Website. You expressly relieve Treatd of any and all liability related to the functionality, content or information contained on any Third Party Website. In addition, your dealings with or participation in promotions of third parties (including health care, beauty & wellness providers) found on the Site, including payment and delivery of goods or services or any other terms (such as warranties) are solely between you and the third parties. You agree that Treatd shall not be responsible to you for any loss or damage of any kind relating to your dealings with such third parties.
  16. Treatd Intellectual Property Rights: Treatd grants you a limited, personal, revocable, nonassignable and non-exclusive license to use the Site. Treatd owns the text, photographs, videos, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software and all other elements and components of the Site (“Treatd Content”), excluding your Submissions. Treatd owns the copyrights, trademarks, service marks, trade names and other intellectual property and proprietary rights throughout the world associated with the Treatd Content and the Site which are protected by copyright, trade dress, patent, trademark laws and all other applicable intellectual and proprietary rights and laws. You may not modify, reproduce, republish, frame, download, transmit, distribute, rent, lease, loan, sell, assign, license, sublicense, reverse engineer, disassemble, publicly display or create derivative works based on any of the Treatd Content in whole or in part, or the Site except as expressly authorized in writing by Treatd. In addition, Treatd does not grant any express or implied rights in and to the Site or Treatd Content, and all rights in and to the Site and the Treatd Content, are retained by Treatd.
  17. Treatd Disclaims All Warranties: TREATD PROVIDES THE SITE, THE TREATD CONTENT AND ALL INFORMATION, MATERIALS AND OTHER CONTENT AVAILABLE ON THE SITE ON AN “AS IS” AND ” AS AVAILABLE” BASIS “WITH ALL FAULTS.” TREATD DISCLAIMS ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS OR IMPLIED) AS WELL AS ANY GUARANTEES OR CONDITIONS RELATED TO THE SITE. WITHOUT LIMITING THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY LAW, TREATD DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT AND NON-INFRINGEMENT. TREATD DOES NOT REPRESENT OR WARRANT THAT THE SITE OR ANY ELECTRONIC COMMUNICATION FROM TREATD WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR DEFECTS. IN ADDITION, TREATD EXPRESSLY DISCLAIMS ANY AND ALL RESPONSIBILITY AND LIABILITY WITH RESPECT TO SEPARATE AGREEMENTS YOU MAY MAKE WITH HEALTH CARE, BEAUTY & WELLNESS PROVIDERS OR OTHER THIRD PARTIES AND YOU WILL LOOK SOLELY TO SUCH PERSONS AND/OR ENTITIES WITH RESPECT TO ANY AND ALL CLAIMS ARISING OUT OF SUCH AGREEMENTS. FURTHER, TREATD DOES NOT REPRESENT OR WARRANT THAT THE SITE OR THE CONTENT AVAILABLE ON THE SITE WILL ASSIST YOU IN FINDING A SUITABLE HEALTH CARE, BEAUTY & WELLNESS PROVIDER OR FOR ANY OTHER PURPOSE. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SITE IS ENTIRELY AT YOUR OWN RISK. WHILE TREATD TAKES REASONABLE PHYSICAL, TECHNICAL AND ADMINISTRATIVE MEASURES TO SECURE THE TREATD SITE, TREATD DOES NOT GUARANTEE THAT THE TREATD SITE CANNOT BE COMPROMISED.
  18. LIABILITY LIMITATION; YOUR EXCLUSIVE REMEDY:TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL TREATD OR THE TREATD PARTIES BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED, TO LOSS PROFITS AND DAMAGES THAT RESULT FROM INCONVENIENCE, DELAY OR LOSS OF USE) ARISING OUT OF OR RELATING TO THE USE OF THE SITE EVEN IF TREATD OR ANY OF THE TREATD PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, IN NO EVENT SHALL TREATD BE LIABLE TO YOU OR TO ANYONE FOR ANY DECISION MADE OR ACTION TAKEN BY A PARTY (INCLUDING, WITHOUT LIMITATION, BY ANY USER OR COMMUNITY MEMBER) IN RELIANCE ON ANY CONTENT OR OTHER INFORMATION ABOUT HEALTH CARE, BEAUTY & WELLNESS PROVIDERS OR PROCEDURES POSTED ON THE SITE. TREATD SHALL NOT BE LIABLE FOR ANY DAMAGES, DELAYS, OR NON-PERFORMANCE CAUSED BY FACTORS OR ACTIVITIES BEYOND ITS REASONABLE CONTROL, INCLUDING DELAYS AND NONPERFORMANCE CAUSED BY VIRUSES, DENIAL OF SERVICE ATTACKS, OTHER ACTS OR OMISSION OF THIRD PARTIES, INTERNET SERVICE PROVIDER FAILURES, STRIKES, LOCKOUTS, WORK SLOWDOWNS OR STOPPAGES, ACCIDENTS, FIRES, TERRORISM, ACTS OF GOD, GOVERNMENT RESTRICTIONS, MECHANICAL, ELECTRONIC OR COMMUNICATIONS FAILURES, WAR OR INSURRECTION.NOTWITHSTANDING ANYTHING IN THESE TERMS, THE AGGREGATE LIABILITY OF THE TREATD PARTIES TO YOU IN CONNECTION WITH THE SITE (INCLUDING ANY THIRD PARTY CONTENT ON THE SITE) AND THESE TERMS WILL BE LIMITED TO THE AMOUNT, IF ANY, PAID BY YOU TO TREATD FOR USE OF THE SITE IN THE SIX (6) MONTHS PRIOR TO THE ACT THAT GAVE RISE TO THE LIABILITY, EVEN IF TREATD HAS BEEN ADVISED OF THE POSSIBILITY OF ANY OF THE FOREGOING TYPES OF LOSSES OR DAMAGES.Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
  19. Changes to the Site; Updates, Suspension of Your Use of the Site; Service Account Closure: We may change the Site or delete features of the Site at any time and for any reason without notice in our sole discretion. We are not obligated to provide maintenance, technical support or updates to you for the Site, but we may provide these in our discretion. We may terminate or suspend your use of the Site at any time in our discretion. Our termination or suspension may be without cause and/or without notice. You may terminate your use of the Site and close your Service Account at any time, with or without cause, upon notice to us as specified in the customer support or email: hello@treatd.co.uk area. Upon termination, your right to use the Site ceases immediately. Once your use of the Site is terminated or suspended, any data you have stored on the Site may not be retrieved later. In addition, even if you stop using the Site or your account is suspended by Treatd, Treatd may continue to show some or all of your Submission.
  20. Jurisdiction: Treatd controls and operates the Site from its offices in London in the United Kingdom and Treatd does not represent that the Site, the Content, the Treatd Content or the Submissions by either health care & wellness providers or community members, are appropriate, available or may be downloaded for use outside the United Kingdom. If you are located outside the United Kingdom and you use the Site and the Service, then you are responsible for complying with all of your local laws if and to the extent your local laws are applicable. These Terms and the Site are governed by United Kingdom law, excluding any conflicts of law provisions. Registering for a Service Account, accessing, browsing or otherwise using the Site means you hereby consent to the exclusive jurisdiction of UK law and you waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the courts of UK law.
  21. Indemnification: You agree to indemnify and hold harmless Treatd and the Treatd Parties from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable attorneys’ fees, arising out of or in connection with: (a) your Submissions or any other Content you post or submit to or through the Site; (b) your use of the Site; (c) your conduct in connection with the Site or with other users of the Site, and; (d) any violation of these Terms, any other Treatd policy or of any law or the rights of any third party.
  22. Claim must be filed within one year: Any dispute, claim or controversy arising out of or relating to these Terms, Treatd or the Site or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of these Terms to arbitrate, shall be determined by final and binding arbitration as the sole and exclusive remedy for such controversy or dispute. Any claim shall be made by filing a demand for arbitration within one (1) year following the event first giving rise to the claim. The arbitration shall be held in London, United Kingdom before one arbitrator. The arbitration shall be governed by the UK Arbitration Act and the arbitration shall take place according to the rules of the UK Arbitration Association. Judgment on the Award may be entered in any court having jurisdiction. Each party shall bear all of its own costs of arbitration except the fee for the arbitrator shall be equally split between the parties. The arbitrator shall not have the authority to modify these Terms or award punitive or exemplary damages to either party. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Seeking any such remedies shall not constitute a waiver of either party’s right to compel arbitration.

TREATD PROVIDER TERMS OF SERVICE

These Health Care, Beauty & Wellness Provider Terms of Service (“HCWP Terms”) are between you, a health care & wellness provider, (“you,” “your” or “health care & wellness provider”) and Treatd (“Treatd,” “we” or “our”). These HCWP Terms govern: (i) your access and use of the website, www.treatd.co.uk, and the services and information available on the website (collectively, “Site”) whether or not you access the Site through your computer, mobile device or any Treatd application (“Treatd App”); and (ii) your submission of any and all content to Treatd by any means now known or hereafter developed at any time. These HCWP Terms constitute a binding agreement between you and Treatd and the term of these HCWP Terms will take effect at the time you click “I accept” or use the Site.

PLEASE READ THESE HCWP TERMS CAREFULLY. BY CLICKING ON “I AGREE,” OR BY BROWSING, ACCESSING AND/OR USING THE TREATD SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE HCWP TERMS, HEALTH CARE, BEAUTY & WELLNESS CODE OF CONDUCT, HEALTH CARE, BEAUTY & WELLNESS PROVIDER LISTING CRITERIA, THE HEALTH CARE, BEAUTY & WELLNESS PROVIDER PHOTO & VIDEO GUIDELINES AND THE TREATD PRIVACY POLICY (ALL OF WHICH ARE INCORPORATED HEREIN BY REFERENCE). IF YOU DO NOT AGREE TO ABIDE BY OR BE BOUND BY THESE HCWP TERMS OR ANY OF THE TREATD GUIDELINES OR POLICIES IDENTIFIED ABOVE, THEN DO NOT REGISTER FOR AN ACCOUNT OR ACCESS AND USE THE SITE. IF YOU ARE ACCEPTING THESE HCWP TERMS ON BEHALF OF A HEALTH CARE, BEAUTY & WELLNESS PROVIDER OR HEALTH CARE, BEAUTY & WELLNESS PROVIDER ENTITY, YOU REPRESENT AND WARRANT THAT YOU HAVE THE AUTHORITY TO BIND SUCH INDIVIDUAL OR ENTITY TO THESE HCP TERMS. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE TO ANY OF THESE HCWP TERMS, THEN YOU ARE NOT PERMITTED TO USE THE SITE.

  1. MODIFICATION

    Treatd reserves the right to make changes to the Site, these HCWP Terms and other policies at any time, including but not limited to charging fees at any time for the Site. If Treatd makes material changes to these HCWP Terms or other policies, then Treatd will either notify you by email or by posting a notice on the Site prior to the effective date of the changes. Treatd will also indicate at the bottom of this page the date these HCWP Terms were last updated. These HCWP Terms are effective upon acceptance by new users. For current users, these HCWP Terms are effective as of January 23, 2020 and supersede all previous versions of the Treatd HCWP Terms or any other Treatd terms of service that you accepted when you registered for an account with Treatd. If any section of these HCWP Terms shall be deemed invalid, void or for any reason unenforceable, then that section shall be deemed severable and shall not affect the validity of the remaining sections of these HCWP Terms. Your continued use of the Site after any such changes are posted constitutes your acceptance of the new HCWP Terms. If you do not agree to abide by these or any future HCWP Terms, you may not use or access the Site.
  2. YOUR HEALTH CARE & WELLNESS PROVIDER ACCOUNT; EMAIL CONSENT

    In order to use some of the features on the Site, including updating and adding content to a health care & wellness provider profile or a practice profile, you are required to register and provide information about yourself to Treatd and create a verified health care, beauty & wellness provider account (“HCWP Account”). It is your responsibility to maintain the confidentiality of your account information, including your HCWP Account password and you are responsible for all activities that occur in connection with your HCWP Account. In addition, health care, beauty & wellness providers may claim and create a health care, beauty & wellness provider profile page on the Site. The health care, beauty & wellness provider profile pages are subject to the Health Care Provider Listing Criteria. In creating your health care, beauty & wellness provider profile page, you agree that any information submitted by you and posted to your health care, beauty & wellness provider profile page is accurate, true and correct. In addition, you agree to keep the information on your health care, beauty & wellness provider profile page updated. You are responsible for all activities that occur in connection with your health care, beauty &wellness provider profile page. You must tell us right away about anyone using your HCWP Account or health care, beauty & wellness provider profile page without your consent, or any security breach that relates to your HCWP Account or health care, beauty & wellness provider profile page. By using the Site, you consent to receive emails from Treatd, which may include commercial emails provided such emails are in accordance with the preferences you select in the email and notifications page of your HCWP Account. You may change such preferences by changing your account settings on the notifications page of the “My Profile” section in your HCWP Account or via the unsubscribe link in all commercial emails. Please note that as long as you maintain an account, you may not “opt out” of receiving service or account related emails from Treatd. Treatd reserves the right to refuse providing services or the Site to anyone, including terminating your HCWP Account and/or preventing you from accessing the Site or your HCWP Account, with or without cause, at any time and in its sole discretion.
  3. HOW AND WHEN YOU MAY USE THE SITE

    As a health care, beauty & wellness provider, you may use the Site to respond to community members’ questions and to create a health care, beauty & wellness provider profile or practice profile, (including, uploading photos, videos and articles to your profile). You or an authorised representative from your office may claim your health care & wellness provider profile or practice profile on the Site but you may not post false or misleading information on your profile. Except to the extent you are otherwise directly authorised by Treatd, you may not use the Site to: • Promote a product, service or procedure that you, your employer or practice sells, markets, distributes or performs or is otherwise affiliated with; • Praise, recommend, describe any experiences with, or otherwise promote a health care & wellness provider or other person that is yourself or someone to whom you are related or with whom you work or have previously worked with; • Trade reviews with other health care providers or businesses, compensate someone or be compensated for writing a review; • Praise, recommend, describe positive experiences with, or otherwise promote a business you own or by whom you are employed; or • Either post or allow a member of your staff to post a false or misleading review, (including reviews that are fabricated or exaggerate results) or any reviews about you on the Site. However, nothing contained herein will be construed as prohibiting you from posting content in a response to content posted by another community member about your business; provided, that (a) you have provided true and accurate registration information to Treatd about yourself, (b) you have clearly explained in your response that you are making a statement on behalf of the business (including your affiliation with the business), (c) your response is limited solely to providing factual information and explanations to refute any statements or allegations in the posted content about your business and your response does not violate any applicable privacy laws (including, but not limited to DPA), and (d) your response does not otherwise attempt to promote your business or serve any commercial purposes, as determined in the sole discretion of Treatd. Additionally, you may not use the Site: • If you are under 18. • In any way or for any purpose that is against any local, state, federal or any other applicable laws. • In any way or for any purpose that harms or endangers us or our affiliates, resellers, distributors, service providers and/or suppliers (collectively, the “Treatd Parties”), or any customer of a Treatd Party; • To exploit, solicit or harm minors; • To copy any content from the Site, including photographs, and post those photographs or other content on any third-party website, including your own website. • To post or submit any content that is racist, sexist, inflammatory, defamatory, derogatory, hateful, harassing, threatening, abusive, profane, obscene, vulgar or sexually explicit, false, misleading, fraudulent, invasive of another’s privacy or publicity rights, infringing of another’s intellectual property rights, contains any trade secrets or other confidential information, or otherwise offensive or objectionable or violates any applicable laws; • To provide or purport to provide medical advice, prescription, diagnosis, or treatment recommendations to individual community members; • To register for multiple accounts or use the account of another person without their authorisation; • To spam any community members or other users of the Site or to attempt to solicit business or direct community members or other users of the Site to a non-Treatd site for commercial purposes unless authorised to do so by Treatd or spamming; • You agree not to use any data mining, robots, or similar data gathering and extraction methods in connection with the Site; • To post links to sites or files that contain or are viruses, spyware, malware, or other harmful content; • To attempt to interfere with or disrupt the Site, any security features of the Site or any person’s ability to use the Site; or • For any purposes for which the Site are not intended. In addition, Treatd is not obligated to enforce these HCWP Terms or any other policies or guidelines against other community members, users, health care, beauty & wellness providers or other thirdparties on your behalf. If you believe a community member, health care & wellness provider or other third-party has violated these HCWP Terms or any other guidelines or policies of Treatd, then please contact Treatd by email: hello@treatd.co.uk . Treatd reserves the right to investigate the matter and take whatever action Treatd deems appropriate in its sole discretion.
  4. MATERIALS YOU POST OR PROVIDE; COMMUNICATIONS MONITORING; CONFIDENTIALITY

    As a health care, beauty & wellness provider, you may be able to post or submit comments, answers to community members’ questions, direct messages, photographs, videos (including videos created through a third-party tool) and other materials on or through the Site (“HCWP Content”). You understand your HCWP Content is not confidential and is publicly available for anyone to view and the HCWP Content posted by you must be in compliance with all applicable privacy laws (including, but not limited to, the Data Protection Act (“DPA”)). Further, Treatd is not responsible for the security of any information transmitted through the internet or the Site. You also understand that any HCWP Content posted by you may not violate these HCWP Terms (including section 3 of these HCWP Terms) or any other guidelines and policies of Treatd as well as any applicable UK & local laws (including, but not limited to the rules and laws of medical boards) and the information you provide must not be false, inaccurate or misleading. Treatd does not claim any ownership rights in your HCWP Content. However, by submitting HCWP Content on the Site you are hereby expressly granting Treatd a nonexclusive, irrevocable, worldwide, perpetual, royalty-free license (including sublicense) to use, copy, distribute, publicly display, publicly perform, modify (including create derivative works) or transmit (including digital transmission of a sound recording, if applicable) your HCWP Content, in connection with the the Site, any Treatd App and the Treatd business, including without limitation promoting and redistributing part or all of the Site, any Treatd App or the Treatd business, in any media formats and through any media channels now known or hereafter developed without any compensation or obligation to you. You also grant Treatd permission to use your name, likeness and voice in connection with your HCWP Content. In addition, by posting or uploading HCWP Content to the Site, you hereby waive any rights of privacy or publicity. You also grant Treatd the permission to grant any of the above rights to other persons or entities, including, but not limited, for the purpose of promoting the Site, any Treatd App or the Treatd business without any compensation or obligation to you. You also grant Treatd the right and authority to send takedown notices (on your behalf) related to your HCWP Content to any individual or entity under the Digital Millennium Copyright Act. In addition, for each HCWP Content you post or submit, you represent and warrant that you have all rights and permission necessary for you to post or submit the HCWP Content and to grant the licenses and permissions in this section. Further, you represent and warrant that the HCWP Content does not violate any law. You also understand and agree that Treatd may, in its sole discretion, refuse, or remove part or all of your HCWP Content from the Site at any time. Treatd reserves the right to review and monitor HCWP Content but is under no obligation to do so. In addition, Treatd is not responsible for screening, monitoring or editing the HCWP Content. Treatd may disclose information about you, including the contents of such HCWP Content, if we deem it necessary to: (1) conform to legal requirements or respond to legal process; (2) ensure your compliance with these HCWP Terms or other Treatd guidelines or policies; or (3) protect the rights, property, or interests of Treatd, its employees, its community members, its partners or the public.
  5. REVIEWS OR CONTENT POSTED BY OTHERS.

    Treatd does not have any responsibility, including editorial control, of any content posted by other Treatd community members, health care & wellness providers or other third party content providers on the Site. The statements or content posted by Treatd community members, health care & wellness providers or other third party content providers on the Site are those of the community members, health care & wellness providers or other third party content providers and are not the opinion of Treatd. Treatd does not make any representations or warranties about the accuracy or reliability of the content, including the opinions, statements or information posted by the Treatd community members, health care & wellness providers or other third party content providers on the Site. The Treatd community members, health care & wellness providers and other third party content providers are solely responsible for the content posted by them respectively. Treatd does not endorse or recommend any specific content, procedures, products, opinions, health care & wellness providers or any other material or information available on the Site. In addition, the health care & wellness providers featured on the Site are not employees or independent contractors of Treatd. There may be medical related or health related materials posted by Treatd community members, health care & wellness providers or other third parties that may contain nudity. If you find these materials to be offensive, then you may want to use the Site in such a way as to limit your viewing of this material.
  6. COPYRIGHT POLICY.

    If you believe that your HCWP Content or any other content has been used in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify Treatd at hello@treatd.co.uk . Provide all of the following in writing: (1) identify the copyrighted work you claim has been infringed or if multiple copyrighted works, then a representative list of such works on the Site; (2) identify the material on the Site that you claim is infringing and with enough detail so that we may locate the material; (3) provide a statement that you have a good faith belief that the use of the material on the Site is not authorised by the copyright owner, its agent, or the law; (4) provide a statement declaring that the notification is accurate, and, under penalty of perjury, that you are the owner of the copyright interest involved or that you are authorised to act on behalf of the exclusive owner; (5) provide information reasonably sufficient to permit Treatd to contact you, such as an address, telephone number, and email address; and (6) your physical or electronic signature. Upon receipt of notice as described above, Treatd will take whatever action, in its sole discretion, it deems appropriate, including removal of the alleged infringing material from the Site.
  7. PHOTOGRAPH/VIDEO POLICY.

    Health care & wellness providers must have consent from individuals and follow all DPA requirements (as well as these HCWP Terms, Health care & Wellness Code of Conduct and Health Care & Wellness Provider Photo & Video Guidelines) before uploading, submitting or posting any photographs or videos (including the use of any third-party video tool whether or not provided by Treatd) of individuals on the Site. When you upload or submit any photo or video of an individual, you represent and warrant that you have the appropriate consent and license to do so and the uploading or submission of the videos or photographs to the Site will not violate these HCWP Terms, the Health care & Wellness Code of Conduct, the Health Care & Wellness Provider Photo & Video Guidelines, or any other applicable laws, including any applicable privacy laws (such as DPA). You also agree to indemnify Treatd and the Treatd Parties against any third-party claims related to the uploading or submitting of any videos or photographs by you or anyone affiliated with you (including an agent, employee of your practice or other third party acting on your behalf).
  8. TREATD ADVERTISING

    If you purchase advertising from Treatd or offer any Special Offers on the Site, then the applicable agreement or the Treatd Special Offers Program Terms of Use will apply to you in addition to these HCWP Terms.
  9. LINKS TO OTHER WEBSITES

    The Site and the Treatd App may contain links to other websites maintained by third parties (“Third Party Website”) or you may be able to log into the Site or the Treatd App through a Third Party Website. Third Party Websites are not under the control of Treatd and Treatd does not endorse or assume any responsibility for the content, information or functionality of any Third Party Website. As a result, your access or use of any Third Party Website is at your own risk and these HCWP Terms, the Treatd Privacy Policy, Health care & Wellness Code of Conduct and any other Treatd policies do not apply or govern any Third Party Website or your use of any Third Party Website. You expressly relieve Treatd of any and all liability related to the functionality, content or information contained on any Third Party Website. In addition, your dealings with or participation in promotions of third parties found on the Site, including payment and delivery of goods or services any other terms (such as warranties) are solely between you and the third parties. You agree that Treatd shall not be responsible for any loss or damage of any kind relating to your dealings with such third parties.
  10. TREATD INTELLECTUAL PROPERTY RIGHTS

    Treatd grants you a limited, personal, revocable, nonassignable and nonexclusive license to use the Site. Treatd owns the text, photographs, videos, visual interfaces, interactive features, graphics, design, compilation, computer code, products, software and all other elements and components of the Site (“RealTreatdSelf Content”), excluding your HCWP Content and community members’ submissions. Treatd owns the copyrights, trademarks, service marks, trade names and other intellectual property and proprietary rights throughout the world associated with the Treatd Content and the Site, which are protected by copyright, trade dress, patent, trademark laws and all other applicable intellectual and proprietary rights and laws. You may not modify, reproduce, republish, frame, download, transmit, distribute, rent, lease, loan, sell, assign, license, sublicense, reverse engineer, publicly display or create derivative works based on any of the Treatd Content in whole or in part, or the Site except as expressly authorized in writing by Treatd. In addition, Treatd does not grant any express or implied rights in and to the Site and the Treatd Content, and all rights in and to the Site and the Treatd Content, are retained by Treatd.
  11. TREATD DISCLAIMS ALL WARRANTIES

    TREATD PROVIDES THE SITE “AS IS” “WITH ALL FAULTS” AND ” AS AVAILABLE.” YOUR USE OF THE SITE IS AT YOUR OWN RISK. TREATD DISCLAIMS ALL WARRANTIES (WHETHER EXPRESS OR IMPLIED), GUARANTEES OR CONDITIONS RELATED TO THE SITE. WITHOUT LIMITING THE FOREGOING, TO THE FULLEST EXTENT PERMITTED BY LAW, TREATD DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT AND NON-INFRINGEMENT AS WELL AS ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, QUALITY, PERFORMANCE AND SUITABILITY OF THE SITE. TREATD DOES NOT REPRESENT OR WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS OR DEFECTS. YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE SITE IS ENTIRELY AT YOUR OWN RISK. IN ADDITION, TREATD EXPRESSLY DISCLAIMS ANY AND ALL RESPONSIBILITY AND LIABILITY WITH RESPECT TO SEPARATE AGREEMENTS YOU MAY MAKE WITH PATIENTS, CONSUMERS, COMMUNITY MEMBERS OR OTHER THIRD PARTIES, AND YOU WILL LOOK SOLELY TO SUCH PERSONS AND/OR ENTITIES WITH RESPECT TO ANY AND ALL CLAIMS ARISING OUT OF SUCH AGREEMENTS. WHILE TREATD TAKES REASONABLE PHYSICAL, TECHNICAL AND ADMINISTRATIVE MEASURES TO SECURE THE SITE, TREATD DOES NOT GUARANTEE THAT THE SITE CANNOT BE COMPROMISED.
  12. LIMITATION OF LIABILITY; YOUR EXCLUSIVE REMEDY

    TO THE EXTENT PERMITTED BY LAW, IN NO EVENT WILL EITHER TREATD OR THE TREATD PARTIES BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, INCIDENTAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING, BUT NOT LIMITED, TO LOSS PROFITS AND DAMAGES THAT RESULT FROM INCONVENIENCE, DELAY OR LOSS OF USE) ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE EVEN IF TREATD OR ANY OF THE TREATD PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, IN NO EVENT SHALL EITHER TREATD OR THE TREATD PARTIES BE LIABLE TO YOU OR TO ANYONE FOR ANY DECISION MADE OR ACTION TAKEN BY A PARTY (INCLUDING, WITHOUT LIMITATION, BY ANY USER OR COMMUNITY MEMBER) IN RELIANCE ON ANY CONTENT OR OTHER INFORMATION ABOUT HEALTH CARE PROVIDERS OR PROCEDURES POSTED ON THE SITE. TREATD AND THE TREATD PARTIES SHALL NOT BE LIABLE FOR ANY DAMAGES, DELAYS, OR NONPERFORMANCE CAUSED BY FACTORS OR ACTIVITIES BEYOND THEIR REASONABLE CONTROL, INCLUDING DELAYS AND NONPERFORMANCE CAUSED BY VIRUSES, DENIAL OF SERVICE ATTACKS, OTHER ACTS OR OMISSION OF THIRD PARTIES, INTERNET SERVICE PROVIDER FAILURES, STRIKES, LOCKOUTS, WORK SLOWDOWNS OR STOPPAGES, ACCIDENTS, FIRES, TERRORISM, ACTS OF GOD, GOVERNMENT RESTRICTIONS, MECHANICAL, ELECTRONIC OR COMMUNICATIONS FAILURES, WAR OR INSURRECTION. NOTWITHSTANDING ANYTHING HEREIN, THE AGGREGATE LIABILITY OF TREATD TO YOU IN CONNECTION WITH THE SITE (INCLUDING ANY THIRD PARTY CONTENT ON THE SITE) AND THESE HCWP TERMS WILL BE LIMITED TO THE AMOUNT, IF ANY, PAID BY YOU TO TREATD IN THE SIX (6) MONTHS PRIOR TO THE ACT THAT GAVE RISE TO THE LIABILITY, EVEN IF TREATD HAS BEEN ADVISED OF THE POSSIBILITY OF ANY OF THE FOREGOING TYPES OF LOSSES OR DAMAGES. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
  13. CHANGES TO THE SITE; UPDATES; TERMINATION

    We may change the Site or delete features available on the Site at any time and for any reason. We are not obligated to provide maintenance, technical support or updates to you for the Site, but we may provide these in our discretion. We may terminate or suspend your HCWP Account and your use of the Site or any services we may provide you that are associated with your use of the Site at any time in our discretion. Our termination or suspension may be without cause and/or without notice. You may terminate your use of the Site at any time, with or without cause, upon notice to us as specified in the customer support area on the Site. Upon termination, you may no longer use or access the Site. Once your use of the Site is terminated, any data you have stored on the Site may not be retrieved later. In addition, even if you terminate your use of the Site, Treatd may continue to show some or all of your HCWP Content.
  14. JURISDICTION

    Treatd controls and operates the Site from its offices in London, United Kingdom and Treatd makes no representation that the HCWP Content, content submitted by community members or any other content available on the Site or the Site are appropriate, available or may be downloaded for use outside the United Kingdom. You are responsible for complying with all of your local laws, if and to the extent your local laws are applicable. These HCWP Terms and the Site are governed by UK Law, excluding any conflicts of law provisions. When you register for an account and click “I accept”, submit content to the Site, access, browse or otherwise use the Site, this means you hereby consent to the exclusive jurisdiction of the United Kingdom and you waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the federal courts of the United Kingdom.
  15. INDEMNIFICATION

    You agree to indemnify and hold harmless Treatd and the Treatd Parties from and against any and all losses, liability, claims, demand, damages, costs and expenses, including reasonable attorney’s fees, arising out of or in connection with: (i) any HCWP Content you post or submit to or through the Site; (ii) your use of the Site; (iii) your conduct in connection with the Site or with other health care & wellness providers and community members of the Site; (iv) any breach of these HCWP Terms, other Treatd policies and guidelines; or (v) any violation of any law or the rights of any third party (including, but not limited to any violation of DPA or the rules, laws, guidelines or policies of any state medical board).
  16. CLAIM MUST BE FILED WITHIN ONE YEAR; ARBITRATION

    Any dispute, claim or controversy arising out of or relating to these HCWP Terms, Treatd, the Site or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by final and binding arbitration as the sole and exclusive remedy for such controversy or dispute. Any claim shall be made by filing a demand for arbitration within one (1) year following the event first giving rise to the claim. The arbitration shall be held in the United Kingdom before one arbitrator. The arbitration shall be governed by the Arbitration Act and the arbitration shall take place according to the rules of the UK Arbitration Association. Judgment on the Award may be entered in any court having jurisdiction. Each of the parties shall bear all of its own costs of arbitration except the fee for the arbitrator shall be equally split between the parties. The arbitrator shall not have the authority to modify these HCWP Terms or award punitive or exemplary damages to either party. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Seeking any such remedies shall not constitute a waiver of either party’s right to compel arbitration.
  17. YOUR NOTICES TO US

  18. OUR NOTICES TO YOU; CONSENT REGARDING ELECTRONIC COMMUNICATION

    This contract is in electronic form. There may be other information regarding the Site that the law requires us to send you. You agree that we may send you this information in electronic form. You have the right to withdraw this consent, but if you do, we may cancel your ability to use the Site. We may provide required information to you (1) via e-mail at the e-mail address you specified when you registered for a HCWP Account (or subsequently provided when updating your account information), (2) by access to a Treatd website that will be designated in an e-mail notice sent to you at the time the information is available, or (3) by access to a Treatd website that will be generally designated in advance for this purpose. Notices provided to you via e-mail will be deemed given and received on the transmission date of the e-mail. As long as you access and use the Site, you will have the necessary software and hardware to receive these notices. If you do not consent to receive any notices electronically, you must stop using the Site. If you want these HCWP Terms provided to you in nonelectronic form, then please send a request to Treatd at hello@treatd.co.uk . In that request, please provide your full name and address where Treatd can send these HCWP Terms in nonelectronic form.
  19. MISCELLANEOUS

    These HCWP Terms constitute the entire agreement between you and Treatd regarding your use of the Site, and supersedes any prior agreements between you and Treatd relating to your use of the Site. The failure of Treatd to exercise or enforce any right or provision of these HCWP Terms shall not constitute a waiver of such right or provision in that or any other instance. If any provision of these HCWP Terms is held invalid, the remainder of these HCWP Terms shall continue in full force and effect. If any provision of these HCWP Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these HCWP Terms and shall not affect the validity and enforceability of any remaining provisions.

  3. Password and Account Security
    1. You are responsible for the safety and security of your password and log in details. SCOPE & INTRODUCTION

Treatd values your privacy. This Privacy Policy details important information about the collection, use, disclosure, retention and protection of your personal information. Treatd provides this notice about our practices to help you make an informed decision about whether to use or continue using the Site (as defined below).

Please note that any content posted by you onto the Site, including but not limited to reviews, photos, videos, questions, answers, or profile updates, becomes published content and is publicly available for anyone in the world to view. This privacy policy applies to www.treatd.co.uk, our Treatd mobile applications (whether accessed by a tablet, mobile phone or other similar device) and our other websites (collectively, “Site”) whether you browse our Site (without registering for an account) or register for an account to use the Site as either a user or health care & wellness provider. This privacy policy also applies to information we collect in email, text and other electronic messages between you and us.

We have created a separate Cookie Policy to detail our use of cookies and tracking technologies. The Cookie Policy forms part of this privacy policy and the Cookie Policy may be updated from time-totime as specified in this privacy policy.

CHANGES TO THIS PRIVACY POLICY

This Privacy Policy may be revised periodically and this will be reflected by the “effective date” above. If we make any material changes in the way in which your personal information is collected, used or disclosed, then we will notify you through the Site or by email. You are advised to review this privacy policy periodically for any changes. INFORMATION TREATD COLLECTS

Treatd acts as a data controller when it collects personal information from you when you visit our Site or when you register to use the Site or access your account through the Site. For purposes of this privacy policy, “personal information” means any data and information relating to an identified or identifiable natural person. Personal information does not include information that you post on the Site or that is publicly available from government records, as well as de-identified or aggregated consumer information.

INFORMATION TREATD RECEIVES FROM YOU:

  • Registration. You provide us with personal information when you register on the Site and update your account. This information may include: first and last name, geographic location, email address username and password.
  • Form Completion. You may also provide us with your personal information when you voluntarily fill in forms on our Site.
  • Purchases & Promotions. When you purchase paid products or services or participate in giveaways or sweepstakes within the Site, you may provide us with personal information in order to process your payment or entry. As explained below, we use a third party payment processor to process payments on our behalf and we never have access to, store or collect your payment card details
  • User Interactions. You may provide personal information through communications or chats with other users on the Site. You understand that other users may contact you through direct messages and comments on the Site. Any messages that you send to other users through the Site may not be private or confidential if either you or the recipient of the message discloses it to another person or chooses to publicly post it.   • Other Interactive Features. You also provide Treatd with your information when you use certain features on the Site, such as submitting reviews, comments, questions and other postings on the Site (“User Contributions”). You understand that your User Contributions are published or displayed on public areas of the Site, or transmitted to other users of the Site or third parties. Your username (not your email address) is displayed to other users when you post User Contributions to the Site. If you use your first or last name as part of your username or your username is discoverable on the internet, then you are making this personal information publicly available and understand that other users may view this personal information and may be able to identify you from this personal information. Treatd cannot control the actions of other users of the Site with respect to your User Contributions.
  • Troubleshooting & Bug Reporting. You may also provide us with your personal information when you report a problem with our Site.

INFORMATION TREATD COLLECTS AUTOMATICALLY:

  • Cookies Information. When you visit the Site, we (and third parties with whom we partner) may send one or more cookies – a small text file containing a string of alphanumeric characters – to your computer that uniquely identifies your browser.   • Web Beacons. When you use the Site, we may employ third party web beacons or “clear gifs” which are used to track the online usage patterns of our users anonymously (i.e., in a non-personally-identifiable manner). In addition, we may also use web beacons in HTML-based emails sent to our users to track which emails are opened by recipients. When you access the Site from a mobile device or tablet, we may be able to collect your location information if this feature is enabled on your device or provided via Device ID or unique identifier. Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. INFORMATION TREATD RECEIVES FROM OTHER SOURCES

  • Social Media. If you connect your Facebook or other third party social media account to your Treatd account, you understand that Treatd may receive information about you from those third party sites and agree that information may be transmitted into your Treatd account. The information collected by Treatd from third party social media sites is limited to your contact information and username, and may depend on your privacy settings with those third party sites. As a result, you should consult the privacy policies of those third party social media sites. The Treatd website may also host plug-ins or other technologies from various social media sites. When you click on a link provided by a social media plug-in, you are voluntarily establishing a direct connection with the social media site and you should consult the privacy policy of the social media site to learn more about their privacy practices. This privacy policy does not apply to the third party social media websites.

HOW TREATD USES INFORMATION

Treatd uses the information that we collect about you or that you provide to us for a range of different business purposes. We use your personal information to track usage of the Site, to market the Site, to improve the Site features and functionality, to backup our systems and to provide customer support. WHEN TREATD DISCLOSES INFORMATION

THIRD PARTY SERVICE PROVIDERS

We provide personal information and non-personally-identifiable information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing such information on our behalf, including, but not limited to, providing analytics, monitoring our Site, A/B testing, marketing, distribution of surveys or giveaway programs. We require that these parties agree to process such personal information in compliance with this privacy policy and any other appropriate confidentiality and security measures as well as for the sole purpose of providing the specific service to Treatd. The third party service providers are not permitted to share such personal information or use it for any other purpose.

We do not sell your personal information. FULFILL YOUR REQUESTS

We will always use your personal information to fulfil the purpose for which it had been requested. For example, if you submit your first and last name, email address, telephone number, treatment desired and questions or comments through a form on a specific health care & wellness provider’s profile page, then Treatd will disclose this information to the health care & wellness provider identified on the form. In addition, if you submit your mobile phone number through such a form, then you understand and consent to Treatd and/or the health care provider sending you text messages. You understand that standard text messaging fees and data rates may apply. Treatd will provide transparency and state the purpose and terms at the point of collection of such information, and the information you provide through such forms will not used by Treatd for any other purpose. If you purchase products and services through the Site, the payment information is transmitted directly via an encrypted connection to our third-party payment processors. Treatd uses Paypal to process payments, and Paypal store your personal and payment information in accordance with their respective privacy policies. Treatd does not collect or store your payment information. Treatd does collect your name, email address and telephone number in order to process your payment and this information is stored by Treatd in accordance with this privacy policy.

THIRD-PARTY ADVERTISERS

We do not share your personal information (such as name or email address) with other third-party companies for their commercial or marketing use without your consent or except as part of a specific program or feature for which you will have the ability to opt-in or opt-out.

Treatd may allow other companies, called third-party ad servers or ad networks, to serve advertisements within the Site. These third-party ad servers or ad networks use cookies, web beacons and other tracking technologies to send, directly to your browser, the advertisements and links that appear on the Site. They automatically receive your IP address when this happens. In addition, the third-party ad servers or ad networks may use information about your visits to our Site and other websites to provide advertisements about goods and services of interest to you. IN THE EVENT OF MERGER, SALE, OR BANKRUPTCY

Treatd strives to provide you with choices regarding the personal information you provide to us, and we understand that you have rights in your personal information such as: the right to access, correct, delete, object to and restrict the use of your personal information. We also understand that you have the right to obtain a copy of your personal information from us and to withdraw your consent of the processing of your personal information by us. We have created mechanisms to provide you with the following control over your personal information:

CONSUMER RIGHTS AND ACCESS

  • General. You can choose not to provide personal information through our Site, in which case Treatd may not be able to provide certain services to you or respond to your requests.
  • Access, Changes, & Deletion. You can access, review and change your personal information by logging into your account on the Site and visiting your account profile page. You may also send us an email at hello@treatd.co.uk to request access to, correct or delete any personal information that you have provided to us. In some cases, we may not be able to delete your personal information except by also deleting your user account.
  • Treatd Emails. If you do not wish to have your email address or other contact information used by us to promote our Site or other products or services, you can opt-out at any time by logging into the Site and adjusting your user preferences in your account profile or by sending us an email stating your request to hello@treatd.co.uk .If we have sent you a promotional email, you may unsubscribe to receive future emails via the unsubscribe link in that email.
  • Copy of Personal Information. You may also request a copy of your personal information that you have provided to us directly by sending an email to hello@treatd.co.uk . We will provide you a copy of your personal information in a commonly used electronic form.
  • Closing Accounts. You may also close your account by contacting Treatd Community Support. Treatd will disassociate your User Contributions from your account. However, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Site users. In addition, Treatd will continue to retain certain information about you in accordance with the privacy practices in this policy or if required to do so as a result of a legal obligation. This provision does not apply to the accounts of doctors and other service providers, as Treatd will continue to display public provider information for the benefit of consumers regardless of whether an account with Treatd is open or closed.

ACCOUNT VERIFICATION AND PROCESS

In order to fulfil the above requests, Treatd may ask you to verify your identity before responding to such requests. We endeavour to respond to verifiable consumer requests within 30 days of receipt. If we require more time, we will inform you of the reason and the anticipated additional amount of time required. Further, your right to access your personal information may not apply in some cases, including where providing access is unreasonably burdensome or expensive under the circumstances, where such requests are too frequent (requests for a copy of your personal data are typically limited to two times per year), or where it would violate the rights of someone other than the individual requesting access.

ADVERTISING AND ANALYTICS

If you do not want us to use information that we collect or that you provide to us to deliver advertisements, for analytics or remarketing services, then you may opt-out as described below.

  • For analytics, we use Google Analytics, which is a web analytics service that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Site. This data may be shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network. You can opt-out of having your activity on the Site available to Google Analytics by installing the Google Analytics opt-out browser add-on.   • Treatd uses Google AdSense & DoubleClick Cookie on the Site. Google, as a service provider, uses cookies to serve ads on our Site. You may opt out of the use of the DoubleClick Cookie for interest-based advertising by visiting the Google Ads settings web page at: http:// www.google.com/ads/preferences/. You can also opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.
  • Treatd currently uses Google AdWords, which is a remarketing service provided by Google. You can opt-out of Google Analytics for Display Advertising and customise the Google Display Network ads by visiting the Google Ads settings page at: http://www.google.com/settings/ads. In addition, Google also recommends installing the Google Analytics opt-out browser add-on for your web browser, which is available at: https:// tools.google.com/dlpage/gaoptout. This tool provides visitors with the ability to prevent their data from being collected and used by Google Analytics.

RETENTION OF PERSONAL INFORMATION

Treatd will retain your personal information only for as long as is necessary for the purposes set forth in the privacy policy. Treatd will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your personal information to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

OTHER IMPORTANT INFORMATION

OUR COMMITMENT TO DATA SECURITY

Treatd uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. For example, to protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times. We cannot, however, ensure or warrant the security of any information you transmit to the Site and you do so at your own risk. Once we receive your information, Treatd makes commercially reasonable efforts to ensure the security of your information. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

If Treatd learns of a security systems breach, then we may attempt to notify you electronically so that you can take appropriate protective steps. Treatd may post a notice on the Site if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. To receive a written notice of a security breach (or to withdraw your consent from receiving electronic notice) you should notify us using our feedback form.

CHILDREN’S PRIVACY

Protecting the privacy of children is important to Treatd. For that reason, Treatd does not knowingly collect or maintain personal information from persons under 18 years of age, and no part of the Site is directed to persons under 18. If you are under 18 years of age, then please do not use or access the Site at any time or in any manner. If Treatd learns that personal information of persons under 18 years of age has been collected without verified parental consent, then Treatd will take the appropriate steps to delete this information.

VISITING THE SITE FROM OUTSIDE THE UNITED KINGDOM

The Site is hosted in the United Kingdom. If you are accessing the Site from outside the United Kingdom, please be advised that the information you provide Treatd may be transferred to, processed and stored in the United Kingdom where the Treatd servers are located and our central database is operated. You acknowledge and understand that the data protection and other laws of the United Kingdom might not be as comprehensive as those in your country. Through your continued use of the Site (which is governed by U.K. law, this privacy policy, and our Terms of Service), you consent to the transfer of your personal information to the United Kingdom.

CALL MONITORING AND RECORDING

Telephone calls to or from Treatd may be recorded and monitored by us. Treatd records and monitors telephone calls for user support services and for staff training purposes. Treatd retains the recordings for a reasonable period of time in order to fulfill the purpose for which the telephone calls were recorded and then the recordings are deleted.

HOW WE RESPOND TO DO NOT TRACK SIGNALS

Treatd currently does not respond to “Do Not Track” signals because there is not an industry or legal standard for such signals.

AUTOMATED DECISION-MAKING

Treatd does not use any personal information provided by you for the purposes of automated decision-making.

LINKS TO OTHER SITES

Our Site may contain links to other websites that are not operated by Treatd. If you click on a thirdparty link, you will be directed to that third-party’s website. This privacy policy does not apply to the third-party websites and Treatd encourages you to review the privacy policy of the third-party websites you visit.
